Thank you for using the Printify App on ChatGPT! By accessing or using the Printify App on Chat GPT (“Service”) or by accessing our platform, you, the User, agree to these Terms and Conditions (the “Terms”). These Terms govern your use of our Services.
If you do not agree with or cannot comply with these Terms, then you may not use the Service. These Terms apply to all visitors, users, and others who wish to access or use our Service.
By accessing and/or using the Service, you understand, accept, and acknowledge the following:
A. General
- The principal terms applicable to your use of the Services are the Printify Terms of Service, Printify Privacy Policy, and Printify Intellectual Property Policy, as well as any other applicable Printify policy (“Printify Policies”).
- These Terms serve as supplemental to the Printify Policies. In the event of any conflict between these Terms and the Printify Policies, these Terms shall prevail.
- We reserve the right to revise the Terms from time to time and the most current version will always be posted on the Web Pages. If a revision, in our sole discretion, is material we will notify you. The “Last Updated” date at the top of the Terms reflects the date of the last modification. Your use of the Service following the effective date of any modifications to the Terms will constitute your acceptance of such modification.
- You agree to indemnify and hold Printify and its parent, subsidiaries, affiliates, partners, and Providers (as defined in the Terms of Service) harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your breach of these Terms or our other applicable terms, your violation of any law or the rights of a third party, or your use of the Service, your Inputs, or any Outputs generated therefrom.
B. Privacy notice
- This Service allows you to create and order personalized products by providing requests via ChatGPT and answering additional questions. Our app may guide you to provide certain information for creating or adjusting content for products, however, please provide such Inputs to ChatGPT only at your own discretion and subject to OpenAI Terms of Use and Privacy Policy. The information you provide to ChatGPT will be used as inputs to Google Gemini image generation models for generating Your Content. Thus information you provide must also comply with Google Generative AI Prohibited Use Policy. When you start the order checkout process, we will receive Your Content that was generated. We will collect the personal data necessary to process your order directly from you in our app, therefore, please do not provide your or customers personal data within ChatGPT. Please refer to Printify Privacy Policy for more details about how we process your personal data.
C. Merchant of Record
- Printify will be the merchant of record for all sales made within the Services. Accordingly, Printify shall unilaterally establish its own resale prices for Products (as defined in the Printify Terms of Service) and will handle any disputes, chargebacks, returns, tax-related matters, and all other matters concerning the sale of the Products.
