“Boss Your Shopify Business” Terms and Conditions

General

This Campaign is open to all registered Printify Users as defined in the Printify Terms of Service (available at https://printify.com/terms-of-service/). Exclusions apply.

The Campaign commences on 19 February 2024 at 8:00 AM (UTC) and concludes on 18 March 2024 at 08:00 AM (UTC) (“Campaign Period“). Printify reserves the right to shorten or extend the Campaign Period at its sole discretion, without prior notice.

Printify reserves the right to at its sole discretion, at any time, and upon its own judgment to modify these Terms, any content, rules, and reward conditions at any time, especially in case of any errors, fraud, or unauthorized interference beyond the control of the Company that may jeopardize the security and fairness of the Campaign. Printify reserves the right to cancel the Campaign at any time at its sole discretion.

The Printify Terms of Service (available at https://printify.com/terms-of-service/), together with the Privacy Policy (available at https://printify.com/privacy-policy/) and Intellectual Property Policy (available at https://printify.com/intellectual-property-policy/), apply to these Terms and those participating in the Campaign. In case of any conflict, these Terms shall prevail.

You understand and acknowledge that the Organizer is not liable for any damages, losses, or injuries incurred during or as a result of participating in the Campaign. You participate or engage in the Campaign at Your own risk. In no event shall the Organizer, its officers, directors, agents, affiliates, employees, advertisers, or providers be liable for any indirect, incidental, consequential, or punitive damages, including but not limited to loss of use, loss of profits, or loss of data You may incur as a result of participating in the Campaign.

You agree to indemnify and hold Printify and its parent, subsidiaries, affiliates, partners, and providers harmless from any and all claims, demands, including reasonable attorneys’ fees, made by any third party due to or arising out of Your breach of these Terms or Your violation of any law or the rights of any third party.

These Terms and the underlying agreement between the Parties are exclusively governed by and construed in accordance with the laws of the State of Delaware, U.S.A., without giving effect to such state’s choice-of-law rules that may require the application of the laws of another jurisdiction. Each party, acting for itself and its successors and assigns, hereby expressly and irrevocably consents that any disputes, controversies, or claims arising out of or in connection with this agreement, or the breach thereof, shall be finally settled subject to the claimant’s choice either by arbitration administered by the International Centre for Dispute Resolution in accordance with its International Arbitration Rules, such arbitration shall be seated the in New York, or by the courts of Delaware, as well as the United States District Court for the District of Delaware.

If Printify incurs any chargebacks, disputes, reversals, or other charges that Printify may have incurred due to causes attributable to You in respect to Your account, we reserve the right to:

• Charge You for the relevant amounts incurred.
• Set off any positive balance in Your account against any amounts You owe.

Violation of any term applicable to the Campaign, including, in particular, these Terms, will automatically lead to Printify voiding its offers, canceling rewards, or reversing any payments and/or discounts. The determination of whether a particular User or an account has violated terms applicable to the Campaign shall remain at Printify’s exclusive and sole discretion. At any time, Printify may reclaim any rewards awarded in error. The decision on reclaiming awards shall be final and undisputable.

By participating in the Campaign, you represent and warrant that you have read these Terms and are fully aware of and fully understand the contents of these Terms and you fully and unconditionally agree to and accept these Terms and the decisions of the Organizer, which are final and binding in all matters relating to the Campaign.

Campaign rules

Eligibility requirements

Participation in the Campaign is limited to registered Printify store owners who as of the date of announcement of this Campaign have a Shopify store connected to their Printify account and who have been pre-selected by Printify based on a comprehensive evaluation of various criteria (individually a “Merchant“).

Such Merchants will receive an email inviting them to participate in the Campaign. All interested Merchants must provide their consent to participation in this Campaign by clicking “Yes” in the promotional email about this Campaign.

The Campaign is open to participants residing worldwide.

The Organizer reserves the right to refuse any entry that does not comply with the eligibility requirements of these Terms (“Eligibility Criteria“). Non-compliance with the Eligibility rules and exclusions will lead to automatic disqualification.

Printify accounts may never be created or used in someone else’s name, business name, or address. Printify may request the completion of Know Your Customer (KYC) documentation to verify the details in the User’s account before awarding any rewards.

If You meet the Eligibility criteria, You can elect to participate in the Campaign at any time during the Campaign Period.

Campaign requirements

Merchants who meet the Eligibility Criteria and are interested in participating in the Campaign must fulfill the following to be eligible to receive the Reward:

• during the Campaign Period create and publish at least 25 new unique products to their Shopify store catalogs; and
• keep the newly added products accessible in their Shopify store catalogs at all times between the publishing time and until the end of the Display Monitoring Period.

To clarify, when Printify refers to a “unique product”, it denotes items in the Shopify store catalog that stand out to the average consumer. For instance, adding 25 variations of the same product that solely differ in color or size does not meet this criterion. However, incorporating products that exhibit distinctions in shape, cutout, exclusive design, layering, and other attributes fulfills the requirement. Consequently, Your products should not appear excessively similar. Printify reserves the right, at its sole discretion, to determine whether the products added to the catalog meet the uniqueness standard required for the Campaign.

The Organizer reserves the right to monitor the accessibility of the newly added products at any time between 18 March 2024 at 8:00 (UTC) and 1 May 2024 at 8:00 (UTC) (“Display Monitoring Period“).

The Organizer reserves the right to refuse any entry that does not comply with the participation requirements of these Terms (“Campaign Requirements“). Non-compliance with the Campaign Requirements will lead to automatic disqualification.Those Users who complied with the Eligibility Criteria and Campaign Requirements are participating in the Campaign (“Participants”). The Organizer’s evaluation of the fulfillment of the Eligibility Criteria and Campaign Requirements is final and not subject to appeal. Participants may withdraw their participation at any time by contacting [email protected].

Campaign Reward

All Participants, regardless of their qualification status for the Reward, will receive an email with the results of their participation in the Campaign on 2 May 2024.

All Participants who have fulfilled the Eligibility Criteria and Campaign Requirements will receive a reward of $50 (fifty U.S. dollars) to their Printify Rewards Wallet (“Reward“). The Reward will be automatically transferred to the Printify Rewards Wallet on 4 May 2024

The Rewards added to the Printify Rewards Wallet may be used to cover up to 20% of the cost of each order You make through Printify, excluding shipping and tax. The 20% discount will be automatically applied to every Printify order until You’ve used up all your Rewards. Once the total Reward amount is depleted, you won’t get the 20% discount on future orders. If You don’t spend the full Reward discount in one month, the remaining amount will carry over to the next month until it is depleted.

Rewards are not transferable. No substitution or cash redemption of any Reward, or any portion thereof, is allowed, except at the sole discretion of the Organizer. Organizer reserves the right to substitute any Reward with another reward of equal or greater value. Organizer is not responsible for any inability of any Participant to accept or use any Reward (or portion thereof) for any reason. Participants are solely responsible for all unspecified costs and expenses associated with Reward acceptance and use. Rewards are awarded “as is” with no warranty, representation or guarantee of any kind by the Organizer. Transfer of Reward is not permitted without the permission of the Organizer which may be granted or withheld in its sole discretion and without liability of any kind. A Reward value as stated represents the Organizer’s good faith determination of the approximate retail value of the reward.

Privacy Policy

By participating in the Campaign, You agree that the Organizer as the data controller will process your personal data (full name, place of residence and email address) in accordance with applicable personal data protection laws. Personal data will be collected, processed, and used to process the Campaign under the rules of the Terms stipulated herein. Purposes of data processing include organizing the Campaign, communicating with the Participant, evaluating the fulfillment of the Eligibility Criteria and Campaign Requirements, and granting the Rewards.

Your data will be processed based on:

• Your consent, which you can withdraw by contacting the Organizer at [email protected].
• The Organizer’s legitimate interests, such as the promotion of the Organizer’s brand and other marketing purposes, as well as detecting fraud, abuse, other malicious activities, and/or enforcing or defending the Organizer’s legal rights.
• Provision of your personal data is voluntary but failure to provide the aforementioned personal data will automatically exclude you from participation in the Campaign. Your personal data will be retained as long as necessary for the aforementioned purposes, and as long as there is a legal basis for data processing. If you withdraw your consent, your data will be deleted if it is not required to enforce or defend the Organizer’s legal rights.
