By participating in this Campaign, you agree to these Terms & Conditions, the Printify Terms of Service, and Privacy Policy.

Thank you for your interest in participating in the “Etsy Trends Tool Survey” campaign (“Campaign“), organized by Printify, Inc. (“Company” or “Organizer” or “Printify“). This Campaign is for eligible Printify users as defined in the Printify Terms of Service (available at https://printify.com/terms-of-service/), by giving Users a chance to receive a $5 Printify Balance credit upon successful survey completion. Exclusions apply. No purchase is necessary to enter or participate in this Campaign.

Before you sign up for the Campaign, please read these Terms and Conditions (“Terms“) carefully. These Terms govern participation in the Campaign.

“User,” “You,” and “Your” refers to the individual person, company, or organization that has visited or is using Printify services; that accesses or uses any part of the account; or that directs the use of the account in the performance of its functions.

A. General

1. This Campaign is open to all qualifying Printify Users as defined in the Printify Terms of Service (available at https://printify.com/terms-of-service/). Exclusions apply.
2. The Campaign commences on June 10, 2025 at 1:00 PM (UTC) and concludes on June 16, 2025 at 11:00 AM (UTC) (“Campaign Period“). Printify reserves the right to shorten or extend the Campaign Period at its sole discretion, without prior notice.
3. Printify reserves the right to at its sole discretion, at any time, and upon its own judgment to modify these Terms, any content, rules, and reward conditions at any time, especially in case of any errors, fraud, or unauthorized interference beyond the control of the Company that may jeopardize the security and fairness of the Campaign. Printify reserves the right to cancel the Campaign at any time at its sole discretion.
4. The Printify Terms of Service (available at https://printify.com/terms-of-service/), together with the Privacy Policy (available at https://printify.com/privacy-policy/) and Intellectual Property Policy (available at https://printify.com/intellectual-property-policy/), apply to these Terms and those participating in the Campaign. In case of any conflict, these Terms shall prevail.
5. You understand and acknowledge that the Organizer is not liable for any damages, losses, or injuries incurred during or as a result of participating in the Campaign. You participate or engage in the Campaign at Your own risk. In no event shall the Organizer, its officers, directors, agents, affiliates, employees, advertisers, or providers be liable for any indirect, incidental, consequential, or punitive damages, including but not limited to loss of use, loss of profits, or loss of data You may incur as a result of participating in the Campaign.
6. You agree to indemnify and hold Printify and its parent, subsidiaries, affiliates, partners, and providers harmless from any and all claims, demands, including reasonable attorneys’ fees, made by any third party due to or arising out of Your breach of these Terms or Your violation of any law or the rights of any third party.
7. These Terms and the underlying agreement between the Parties are exclusively governed by and construed in accordance with the laws of the state of Delaware, U.S.A., without giving effect to such state’s choice-of-law rules that may require the application of the laws of another jurisdiction. Each party, acting for itself and its successors and assigns, hereby expressly and irrevocably consents that any disputes, controversies, or claims arising out of or in connection with this agreement, or the breach thereof, shall be finally settled subject to the claimant’s choice either by arbitration administered by the International Centre for Dispute Resolution in accordance with its International Arbitration Rules, such arbitration shall be seated the in New York, or by the courts of Delaware, as well as the United States District Court for the District of Delaware.
8. If Printify incurs any chargebacks, disputes, reversals, or other charges that Printify may have incurred due to causes attributable to You in respect to Your account, we reserve the right to:
   1. Charge You for the relevant amounts incurred.
   2. Set off any positive balance in Your account against any amounts You owe.
9. Violation of any term applicable to the Campaign, including, in particular, these Terms, will automatically lead to Printify voiding its offers, canceling rewards, or reversing any payments and/or discounts. The determination of whether a particular User or an account has violated terms applicable to the Campaign shall remain at Printify’s exclusive and sole discretion. At any time, Printify may reclaim any rewards awarded in error. The decision on reclaiming awards shall be final and indisputable.
10. By participating in the Campaign, you represent and warrant that you have read these Terms and are fully aware of and fully understand the contents of these Terms and you fully and unconditionally agree to and accept these Terms and the decisions of the Organizer, which are final and binding in all matters relating to the Campaign.

B. Campaign Rules

Eligibility requirements

11. Participation in the Campaign is limited to registered Printify store owners who have been pre-selected by Printify based on a comprehensive evaluation of various criteria (each a “Merchant“). Eligible users will receive a notification through an email. Only one entry per Merchant is permitted.
12. You must be older than 18 years of age or the legal age of majority in Your jurisdiction of residence.
13. Employees of the Organizer are not eligible to participate in the Campaign.
14. Non-compliance with the eligibility rules and exclusions will lead to automatic disqualification. The Organizer reserves the right to refuse any entry that does not comply with the eligibility requirements of these Terms.
15. Printify accounts may never be created or used in someone else’s name, business name, or address. Printify may request the completion of Know Your Customer (KYC) documentation to verify the details in the user’s account before awarding any rewards.
16. If You meet the eligibility criteria, You can elect to participate in the Campaign at any time during the Campaign Period.

Campaign requirements

17. Merchants interested in participating in the Campaign must fully complete the “Sign-Up Process“, specifically fill out the survey form, which can be accessed by clicking the “Take the survey” button in the email (“Survey“). To successfully complete the Survey, Merchants must provide responses to all questions in the survey form. You will receive a confirmation at the end of the Survey form. Once submitted, the Survey cannot be repeated. A Merchant who completed the Sign-Up Process becomes a “Registered Participant“.
18. Merchant may sign up for the Campaign at any time during the Campaign Period. While the Survey is intended to remain accessible for completion for an extended duration, only entries submitted during the Campaign Period will be considered for participation in the Campaign.
19. The Organizer reserves the right to refuse any entry that does not comply with the participation requirements of these Terms.
20. Registered Participants may withdraw their participation at any time by contacting [email protected].

C. Campaign Reward

21. All Registered Participants who successfully complete the Survey in full will receive a one-time $5 (five U.S. dollars) Printify Balance credit (“Reward”).
22. The Reward will be issued as an in-store credit to the recipient’s Printify Balance. This means that the Reward will be given as a transfer to the user’s Printify Balance account. For additional information on how payments work on Printify and Printify Balance, please refer to Section I of the Printify Terms of Service (available at https://printify.com/terms-of-service/#menu-payment).
23. The Reward will be issued to the Registered Participant’s Printify Balance no later than June 18, 2025, following successful survey submission and verification.
24. Only one Reward per eligible user is allowed.
25. The Organizer reserves the right to verify submission validity and participant eligibility before issuing the Reward.

D. Privacy Policy

26. By participating in the Campaign, You agree that the Organizer as the data controller will process your personal data (full name, place of residence and email address) in accordance with applicable personal data protection laws. Personal data will be collected, processed, and used to process the Campaign under the rules of the Terms stipulated herein. Purposes of data processing include organizing the Campaign, communicating with the Participant, evaluating the fulfillment of the Requirements, and issuing the Rewards.
27. Your data will be processed based on:
    1. Your consent, which you can withdraw by contacting the Organizer at [email protected].
    2. The Organizer’s legitimate interests, such as the promotion of the Organizer’s brand and other marketing purposes, as well as detecting fraud, abuse, other malicious activities, and/or enforcing or defending the Organizer’s legal rights.
    3. Provision of your personal data is voluntary but failure to provide the aforementioned personal data will automatically exclude you from participation in the Campaign. Your personal data will be retained as long as necessary for the aforementioned purposes, and as long as there is a legal basis for data processing. If you withdraw your consent, your data will be deleted if it is not required to enforce or defend the Organizer’s legal rights.
